2.25 crores to the family of the person who died in the accident. Remedy: Insurance company accepted Madikeri court order

Madikeri : Rs 2.25 crore to the family of a person who died in a road accident in Kodagu district. The Madikeri First Additional District Judge and Motor Accident Claims Tribunal (MACT) ordered the insurance company to pay the compensation.

During the settlement of the Lok Adalat, a verdict was given in this regard and the motor vehicle insurance company of the accused in the case agreed to pay the compensation in two months.

Achal Bopanna (34), who died in the accident, was a resident of Kodagu and was working at Anglo-Eastern Ship Management, a private company in Hong Kong. He was appointed as a captain in the company. In December 2017, Achal met with an accident on the Madikeri-Virajpet road from Mudigere towards Kodagu. The pickup vehicle driven by the accused Ayyappa collided with the bike driven by Achal. Achal, who was seriously injured in the accident, died in the Madikeri district hospital after the treatment failed. Later, Achal’s mother Anila AG and wife Spoorthi filed separate cases seeking compensation from the defendants.

Accused Ayyappa and the accused’s motor vehicle insurance company – Cholamandalam General Insurance Company were the defendants in the case.

Since 2018, the case was being heard in the District Sessions Court of Madikeri, which was settled in the Lok Adalat held on September 9 this year. The Bench had directed to combine the two cases for relief. Similarly, the petitioners Anila and Spurti have claimed Rs.3 crores. He sought compensation. Advocates BB Anand and Ratan Tammaiah argued for him.

After hearing the case, Judge Prashantji ordered the Cholamandalam General Insurance Company to pay a compensation of Rs 2.25 crore to the victim’s family. 

“This is a rare case where Achal was getting a monthly salary of up to Rs 4 lakh. The compensation amount was calculated for the remaining working years of Achal, who died at the age of 34,” said BD Dayanand, representing the insurance company in the case. The insurance company has been ordered to pay the compensation amount within two months and in case of default, the interest amount will be added to it, it said.
