Karnataka :The High Court on Thursday allowed abortion for a sixteen-year-old girl who was pregnant with rape.
The petition filed by the Dharwad High Court Judge NS Sanjay Gowda was yesterday heard by the Dharwad High Court, which granted permission for the medical termination of 16-year-old rape victims under section 3 of the Medical Abortion Act.
The court issued the order while dismissing the victim’s petition seeking direction to the Belgaum District Health Surgeon to terminate the pregnancy.
‘Although there are some statutory limitations in the medical abortion statute in cases of rape of girls, they only apply to doctors. Courts must consider differently the necessity of terminating a medical pregnancy ‘
‘It must be borne in mind that forcible impropriety compels us to bear the burden of crime. A woman should not forget that she has the sacred right to protect her physical integrity, ”the bench said.
