Bengaluru: The Karnataka High Court on Tuesday ordered that a police investigation report could be obtained through the Right to Information Act (RTI).
A single-member bench headed by Justice NS Sanjay Gowda has filed a petition filed by the Information Officer of the Criminal Investigation Division (CID) and the Director General of Police, challenging the order issued by the State Information Commission (RTI) to provide a copy of the investigation report under a RTI.
It is obliged to provide information on any case at the investigation stage. However, upon completion of the investigation, a copy of the police investigation report may be issued by the RTI Act. The order issued by the Commissioner of State Information Commission in this regard is legitimate.
The CID police investigated a case and submitted a B report to the subordinate court. Maleeshappa M. Chikkeri from Dharwad had applied for information to the CID under the RTI Act seeking to issue a B report. However, the CID’s RTI official said the investigation report could not be given.
Thus, Malleshappa had applied to the State Information Rights Commission. The commission commissioner, who recognized it, had instructed the CID to furnish a copy of the investigation report at Malleswappa’s request. The CID’s RTI and the Director General of Police had filed a dispute with the High Court challenging the order. . The High Court dismissed the application, claiming to have a copy of the police investigation report under RTI
